The information must be read thoroughly and carefully before any booking is made. These terms & conditions are not subject to variation without prior written consent from Wilderness Pioneers.

Once a completed booking form has been accepted by written confirmation by Wilderness Pioneers, all persons named on the booking form (here-after to be known as “the client”) will have entered into a binding contract on the basis of these terms and conditions. If you have any questions regarding these conditions, please do not hesitate to contact us.

 

  1. Agreement

Any agreement based on the outlined terms & conditions arises upon the fulfilment of the following

a) Receipt by Woodland Pioneers of a properly completed booking form accompanied by the full payment or deposit specified.

b) Clearance of the full payment or deposit (as detailed in Section 2) into the Wilderness Pioneers bank account.

c) The client signing the booking form shall be deemed to sign for him/herself or acting as a legally recognised agent of the client for and on their behalf, and agrees to make them aware of and abide by these terms and conditions.

d) The agreement is between Wilderness Pioneers and the client and is the sole agreement between those parties. No variation of these Terms & Conditions shall be applicable unless agreed in writing by Wilderness Pioneers before the relevant course.

e) Wilderness Pioneers reserve the right to refuse bookings to any party or individual without need to give a reason solely at the discretion of Wilderness Pioneers. In such circumstances no agreement arises and Wilderness Pioneers will return any payment accompanying the booking form.

 

  1. Payment

a) Full payment is required for courses that are due to start in 6 weeks or under. No deposit is taken in this case, and the full amount is payable.

b) For courses due to start in 6 weeks or greater, you will be billed 20% of the course fee.

c) The balance of the fee (80%) as specified on the booking form must be paid in full 6 weeks prior to the start of the course. If not so paid, Wilderness Pioneers reserve the right to treat the agreement as cancelled by the client in relation to Section 3 below.

 

  1. Cancellation by client on both UK and Overseas Courses

Given the substantial preparation by Wilderness Pioneers prior to any course, the client must be aware of the following conditions and therefore agree to such. If the booking is cancelled by the client for any reason the following charges will be applied:

a) Cancellation more than 6 weeks before the course starts, the deposit is forfeited.

b) Cancellation 4-6 weeks before the course starts will lead to 50% of the course cost will be forfeited.

c) Cancellation less than 4 weeks before the start of the course, 100% of the course fee will be forfeited.

 

  1. Cancellation and alteration of courses by Wilderness Pioneers

Courses offered by Wilderness Pioneers are, by their very nature, exposed to natural forces (e.g. extreme weather conditions, etc.) and although every effort is made to comply to the course content, Wilderness Pioneers reserve the right to alter the course content to match any natural variables. The client acknowledges that information about courses provided by Wilderness Pioneers is given to the best of our ability but that because of natural variables it may be necessary to alter of modify a course and that in such circumstances it is not reasonable for Wilderness Pioneers to be liable for any losses as a result and that our liability is limited accordingly.

In the event that Wilderness Pioneers cancel a course, all monies will be refunded in full, or if preferred, transferred as a deposit for another course. Please not that Wilderness Pioneers require a minimum number of 6 clients to run a course. Wilderness Pioneers reserve the right to cancel all and any booking without reason or notice. Under these unlikely circumstances Wilderness Pioneers agrees to repay in full all and any deposits or course fees to the client.

 

  1. Client conduct

Wilderness Pioneers clients are expected to behave in a reasonable manner at all times and to comply with the reasonable instructions and leadership of Wilderness Pioneers. Wilderness Pioneers reserve the right to remove any client from the course at the instructors/leader’s absolute discretion without recourse to repayment for that course and against the client(s) will if necessary. Circumstance that may warrant exclusion from the course includes (without limitation): intoxication, use of non-prescription drugs, abusive behaviour, inability to meet the rigours of the course from mental or physical reasons, or through lack of appropriate equipment. If you are in any doubt about your ability to meet the rigours of the course, please contact your GP before booking. For removal of any party under such conditions, Wilderness Pioneers will not be liable to any losses as a result and Wilderness Pioneers is also entitled to any reasonable costs arising from removal of said client(s) payable upon demand. In addition, parents, guardians or those in a position of similar responsibility are to ensure the behaviour and safe control of any children to the satisfaction of Wilderness Pioneers.

No unauthorised fires are allowed without the express permission of Wilderness Pioneers. Even if authorised by Wilderness Pioneers, no fire shall be left unattended at any time and adequate means of fire fighting must be provided and available at the site of any such fire at all times.

The client(s) should be advised that knives, axes and the like are very sharp and are not to be touched or moved without the express permission of Wilderness Pioneers, especially children; Parents/carers/guardians should make their children under their charge fully aware of the risks involved with the above.

 

  1. Insurance

Wilderness Pioneers is covered to a level of £5,000,000 for Public Liability and is insured as an Outdoor Activity Provider. Wilderness Pioneers clients are advised to provide their own personal insurance cover from a well established company.

 

  1. Liability

Wilderness Pioneers courses take place in the outdoors, which by its nature is not free from hazards. Whilst every effort is made to minimise risk to clients, the clients accepts that accidents including serious injury and death can occur without Wilderness Pioneers being at fault, and accepts to that extent he/she is taking part in a Wilderness Pioneers course at his/her own risk. Wilderness Pioneers also take no responsibility for any mishaps occurring as a result of the client’s failure to follow instructions. Wilderness Pioneers only accepts liability for physical injury to a client that is shown to result from negligence on the part of Wilderness Pioneers.

The client acknowledges that other loss, damage and expense (including, without limitation, loss of money, loss or damage to clothes and possessions, vehicles, equipment, losses arising on the cancellation of a booking and the expense of delay and harm caused other than by the negligence of Wilderness Pioneers) however arising is not the responsibility of Wilderness Pioneers and that Wilderness Pioneers liability is hereby limited.

The client also recognises attendance of a Wilderness Pioneers course in no way qualifies him/her to teach the course content. Wilderness Pioneers therefore accepts no responsibility for any mishap occurring to third parties taught by attendees of any Wilderness Pioneers course.

 

  1. Complaints

In the unlikely event that a client has a complaint about a Wilderness Pioneers course, the complaint should be made to a representative of Wilderness Pioneers during the event in order that corrective actions can be taken if necessary. Any complaints must be made immediately; Wilderness Pioneers will not accept a complaint after the end of the course. However, should a problem not be resolved at source, a complaint should be made in writing within 28 days. To the extent permitted by law Wilderness Pioneers will not be liable in respect of claims first intimated later than 28 days from the close of the relevant course. Please note all our staff are CRB checked and cleared with the Criminal Records Bureau.

 

  1. Allergies

Whilst we cater for vegetarians and vegans alike, if you suffer from life threatening allergies from substances such as nuts, etc. then we advise you to provide meals for yourself and a reduction to the course costs will be made as a conciliatory measure.

 

  1. Consent Form

The client acknowledges that they must complete and sign a Consent Form, which must be returned to Wilderness Pioneers at least 2 weeks prior to the commencement of the customer’s course.

The consent Form will be emailed to the customer when they make final payment for their course booking.

 

  1. Pricing

Whilst every effort is made to limit prices to those given on the website and other documentation, Wilderness Pioneers reserves the right to alter prices should the costs in hosting a course increase for reasons beyond its reasonable control (including, without limitation, the cost of labour, transport and materials). In the event that a price is altered the client(s) will be notified as soon as reasonably possible and the balance of the altered price will be payable on the same terms as was the original price. In the event of a price increase the client(s) may opt to cancel the booking and will then be entitled to a full refund of all monies paid to Wilderness Pioneers.

 

  1. Other

The clients agree that any photographs taken during the courses by Wilderness Pioneers staff may be published on behalf of or included in printed or digital promotional material for Wilderness Pioneers.

 

  1. Change to this agreement

Wilderness Pioneers reserves the right to update the Terms & Conditions at any time, without notice.
